Terms of Service

By creating an account, accessing, or using LYNK ID (“the Platform”, “we”, “our”, “us”) at www.lynk-id.com or via any associated mobile application or NFC device, you agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree to these terms, do not use the Platform. We reserve the right to update these terms at any time. Continued use after notice of changes constitutes acceptance.

You may use the Platform only if you:

• Are at least 18 years of age (or the age of majority in your jurisdiction)
• Are capable of forming a binding contract
• Are not barred from receiving services under applicable law
• Provide accurate, complete, and current registration information

For school, daycare, or youth-program deployments of guardian-mode tags, a parent or legal guardian must register the account and accept these terms on behalf of the minor.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must:

• Use a strong, unique password and enable two-factor authentication where available
• Notify us immediately at legal@lynk-id.com if you suspect unauthorised access
• Not share your account with any other person
• Not create more than one account per person without our written permission

We are not liable for any loss or damage arising from your failure to keep your account credentials secure.

Contractor Identity & Verification

LYNK ID provides tools for contractors to display verified credentials via NFC badges. Credential verification is performed by the platform based on information you submit. We do not independently license contractors or guarantee the accuracy of any credential. Homeowners and clients rely on displayed credentials at their own discretion.

Check-In / Check-Out & SMS Notifications

The check-in/check-out feature sends automated SMS messages to a client's phone number. You must obtain and record the client's explicit consent before entering their phone number. You are solely responsible for compliance with TCPA, GDPR, and any other applicable messaging laws. LYNK ID will not send SMS messages unless the consent checkbox on the job record has been completed.

Guardian Mode & Safety Tags

Guardian-mode NFC tags are a supplemental safety tool only. They are not a substitute for professional emergency services (call 911 or your local emergency number in a life-threatening situation). LYNK ID does not guarantee SMS delivery, network availability, or the response of any emergency contact.

API Access

API keys grant programmatic access to your account data. You are responsible for keeping API keys confidential and for all requests made with your keys. We may rate-limit or revoke API access at any time for abuse or security reasons.

Physical NFC devices (wristbands, cards, badge hardware) purchased through the Platform are subject to the following:

• Hardware is sold as-is for use with the LYNK ID platform
• We do not warrant that hardware will function with third-party NFC readers or applications
• Lost or damaged hardware is the user's responsibility; replacements are available for purchase
• Tampering with, reverse-engineering, or cloning hardware is strictly prohibited
• Hardware activations are tied to your account and are non-transferable without our consent

Certain features require a paid subscription (“PRO” or higher tier). By subscribing you agree to the following:

• Subscription fees are billed in advance on a monthly or annual basis
• All fees are non-refundable except where required by applicable law
• We may change pricing with 30 days' notice; continued use after the effective date constitutes acceptance
• Failed payments may result in downgrade to the free tier until resolved
• You may cancel your subscription at any time; access continues until the end of the current billing period

You agree not to use the Platform to:

• Violate any applicable law, regulation, or third-party rights
• Submit false, misleading, or fraudulent credential information
• Harvest or scrape user data without authorisation
• Send unsolicited commercial messages (spam) via any notification feature
• Impersonate any person or entity
• Interfere with or disrupt the Platform's infrastructure or servers
• Attempt to gain unauthorised access to any account, system, or network
• Use the Bypass-for-Safety feature for any purpose other than a genuine safety emergency
• Resell, sublicense, or commercialise access to the Platform without our written consent

Violation of these terms may result in immediate suspension or termination of your account without refund.

You retain ownership of content you submit (profile photos, job notes, custom messages, etc.). By submitting content you grant LYNK ID a non-exclusive, worldwide, royalty-free licence to store, display, and process that content solely to provide the Platform's services.

You represent and warrant that your content does not infringe any third-party rights and does not violate any applicable law. We may remove content that violates these terms or that we are required to remove by law.

All intellectual property in the Platform — including software, design, trademarks, logos, and the LYNK ID name — is owned by or licensed to LYNK ID. Nothing in these terms grants you any right to use our trademarks or branding without prior written consent.

You may not copy, reproduce, modify, distribute, or create derivative works of any part of the Platform without our express written permission.

The Platform integrates with third-party services including Google Calendar, Twilio, Firebase, and Vercel. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the acts or omissions of any third-party service provider.

You may close your account at any time via Dashboard → Profile → Danger Zone. Deletion permanently removes your data as described in our Privacy Policy.

We may suspend or terminate your account immediately, without notice or refund, if:

• You violate these Terms of Service
• We are required to do so by law or court order
• Your account poses a security risk to the Platform or other users
• You provide false identity or credential information

Sections 09 (Intellectual Property), 12 (Disclaimers), 13 (Limitation of Liability), 14 (Indemnification), and 15 (Governing Law) survive termination.

The platform is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.

We do not warrant that the Platform will be error-free, that defects will be corrected, that NFC scans will register in all environments, that SMS messages will be delivered, or that the Platform is free of viruses or other harmful components.

LYNK ID is a supplemental identification and safety tool. It is not a substitute for professional emergency services, licensed background checks, or regulated identity verification.

To the maximum extent permitted by applicable law, LYNK ID and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of revenue, personal injury, or property damage — arising out of or related to your use of or inability to use the platform, even if advised of the possibility of such damages.

Our total liability for any claim arising from these terms or from your use of the Platform shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) one hundred US dollars (US $100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In such jurisdictions our liability is limited to the fullest extent permitted by law.

You agree to indemnify, defend, and hold harmless LYNK ID and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your use of or access to the Platform
• Your violation of these Terms of Service
• Your violation of any third-party right, including privacy, intellectual property, or SMS consent obligations
• Any content you submit that causes harm to a third party

These terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Any dispute arising from these terms or your use of the Platform shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.

Class action waiver: You agree that any arbitration or legal proceeding shall be conducted on an individual basis only, and not as a class, collective, or representative action.

If you are an EU or UK resident, nothing in this section limits your right to bring a claim before your local courts or supervisory authorities under applicable consumer protection or data-protection law.

We may update these Terms of Service at any time. When we do, we will revise the “Effective” date at the top of this page. For material changes we will notify registered users by email or by a prominent notice in the dashboard at least 14 days before the change takes effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised terms.

• Entire agreement: These terms, together with the Privacy Policy, constitute the entire agreement between you and LYNK ID
• Severability: If any provision is found unenforceable, the remaining provisions remain in full force
• Waiver: Failure to enforce any right does not constitute a waiver of that right
• Assignment: You may not assign your rights under these terms without our written consent; we may assign ours freely
• Force majeure: We are not liable for delays or failures caused by events outside our reasonable control
